She was born 16 October 1845 in MARION COUNTY, WV, and died 19 November 1882 in WETZEL COUNTY, WV. He married (2) MARY HENDERSHOT 29 September 1886 in WETZEL CO. WV, daughter of Elijah Hendershot and Liva Yoho. She was born 23 September 1862 in WETZEL CO. WV.

A native of West Virginia, was born in Marion County, 02 Sept 1845, and came to Wetzel County in the fall of 1855. He is the son of James Fluharty deceased, and Lucinda J. Jones, who is still living. He was married first in this country, 19 Jan 1865 to Euseba Anne Matheny,. He was married secondly to Mary Hendershot. When the war broke out his heart was with the Northern Cause and was enrolled 25 Mar 1861, at Wheeling, WV, as a private in Co.H 1st WVA V.I. He took active part in the Battles of New Market, Berryville, Cedar Creek, and Piedmont; at the latter conflict he was wounded 05 June 1864, in leg and below the knee; he was taken to hospital at Grafton, WVA, where he received medical treatment for two months. In August, 1864, he was furloughed for 30 days and returned to duty at the end of that time. 'he was consolidated with Co F, and VVI and was honorably discharged 02 June 1865, at Washington, DC. His brothers John and Joseph served in the late war. Comrade Fluharty is by occupation a farmer and his address is Pine Grove.

On this 8th day of May, A.D. one thousand nine hundred and six personally appeared before me, a Notary Public within and for the county and state aforesaid, MARY FLUHARTY, aged 44 years, a resident of Mobley, County of Wetzel, State of W.Va., who, being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the act of Congress approved June 27, 1890, as amended by the act of May 9, 1900.
That she is the widow of DAVID B. FLUHARTY, who was under the name of DAVID B. FLUHARTY on the 24th of March, 1864 as a private in Co. H 1st Regiment W.Va. Vol. INF. and honorably discharged June 2nd 1865, having served ninety days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above.
That she was married under the name of MARY HENDERSHOT to said soldier at W.J. RINE'S residence on the 30th day of September, 1886, by W.J.Rine; that there was no legal barrier to that marriage; that she had not been previously married; that the soldier had been previously married.
Former wife of soldier died about 5 years prior to last marriage.
That the said soldier died April 17, 1906, at his home that she was not divorced from him; that she had not remarried since his death; and that she is without other means of support than her daily labor and an actual net income not exceeding two hundred and fifty dollars per year.
That the said soldier left the following named children who are now living and under sixteen years of age, to wit:

Beckett, a special examiner of the Bureau of Pensions, personally appeared MARY FLUHARTY, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
I am 44 years of age; my post office address is Artisan, Wetzel County, West Virginia, residence near same.
Claimant was born Sept. 23, 1862. I had my mail sent to Mobley because Mr. JOHNSTON who has been doing my writing lives there and he would know when to come to see me about getting testimony.
In an application for pension under law June 27, 1890, as the widow of DAVID B. FLUHARTY who served in Co. H 1st W.Va. Vol. Inf., and who died in this house on April 17, 1906. "I have his death sat down", (In an Agricultural report of 1898 is recorded=DAVID B. FLUHARTY died on the 17th of April 1906".GMB) This death was sat down by his niece a few days after he died---
My maiden name was MARY HENDERSHOT, and I moved here to this neighborhood from the time I was about 18 years, having moved here from near Proctor, this county where I had always lived. I married the soldier DAVID B. FLUHARTY in this county as I recollect the last thing in September and in the year 1886. REV. JACKSON RICE married us. I had not been previously married. My husband had been previously married and once only. His first was MISS METHENY but was married possibly under the name of GRAY-at any rate she, LASEBY ANN was dead about 5 years when I married the soldier, DAVID B. FLUHARTY, and LASEBY ANN died right near Pine Grove. Soldier and I lived together continuously from the date of our marriage to each other in Oct. 1886 until his death in April 17, 1906.
Well my husband had been dead about a month when I made my application for pension. No divorce or separation between us. I have not remarried and don't expect to either. My husband left no life insurance in will or property for that matter. I have no property whatsoever and no income except what my children
and myself earn. My husband died after a long illness, but I don't know what caused his death-Dr. McCLELLAND, Jacksonburg said he had lung fever and pneumonia. He called the last time the day before my husband died. I had eight children by the soldier DAVID B. FLUHARTY, and all are living and the two eldest, Jason Lee and Minnie May are married, the other six are living at home with me.
Neither of us could write to do any good so a record was neglected. All were born here at or near Artisan except ELIJAH BENTON and MINNIE MAY were born near Pine Grove. I can recollect the month and day of birth of each of my 8 children, but the years bother me except in the case of JASON LEE who was born in 1887-"That was the first."

Yes, I am positive that the month and days are correct JASON LEE was born July 16, 1887, the next July after our marriage and he was one year and about nine months old when MINNIE MAY was born, and MINNIE MAY was about one year and nine months old when WALTER FRANCIS was born. That is as nearly as I can recollect. Well, sir, WALTER FRANCIS was two years and three days old when DESSIE, a girl, not Dennis, a boy - was born- two years from January 20th to January 23rd. No, I can't tell you the year of WALTER F. 's birth or the year of DESSIE'S birth- But my idea is that Jan'y 20th last was his 16th birthday, and that DESSIE was only 14 years old Jan'y 23rd last. Well DESSIE was born two years and from Jan'y 23rd to this 18th of March before JASPER N. was born but I can't recall the year- No, not over 3 years, that is not correct. Not three years between any of these births except the last two there was about 4 years between theirs. I reckon from March 7th to May 15th less than four years. Well JASPER NEWTON was two years old and from March 18th to Oct. 17th older than ELIJAH B. , but I forgot the year. Well Elijah B. was two years old from Oct. 17th till May 17th old when NICHOLAS M. was four years less from Mar. 7 to May 15th old when JAMES HOWARD was born. Well I can't say as to the respect ??? believes my husbands statement to this office over mine.

Or character- I am advised that in the former WALTER F. is shown to have been born in 1891 and DESSIE in 1893, whereas my recollection shows them born in 1890 and 1892 respectively, but I can't correct the ????? anymore than to say, that the periods between their births are actually given today. I tried to tell Mr. Johnston as best I could but he evidently got the years of WALTER'S and DESSIE'S wrong. I had no Doctor's at any of them except in the case of ELIJAH.
My brother JASON HENDERSHOT and I tried to figure out their years not long ago last summer-I believe and he put down what he thought their correct ages from what I told him, he not recalling any of their ages himself-(List shown and agrees with family calculation and shows NICHOLAS born May 15, 1900 and JAMES H. March 7, 1904-GMB) When WALTER was born my mother LIVA HENDERSHOT was here. Others present are now dead. When DESSIE was born LIVA HENDERSHOT, EMILY HAUGHT were present. When JASPER N. was born, LIVA HENDERSHOT, EMILY HAUGHT and SARAH A. COOPER were present. When ELIJAH B. was born, he was born on SHENANGO RUN, DR. STONE was present as soon as he could get there, and Mrs. MARIA(AMARZIAH) BROWN and GRANDMA FLUHARTY now dead. When NICHOLAS M. was born EMILY HAUGHT, S.A. COZART were present. I have no attorney--I do not wish to be present or separated?? during the further examination you pose about home or elsewhere

There is no particular event that I recall by which I can fix the date of birth of anyone of my children except in the case of WALTER F., and he was born on Jan'y 20th immediately following the date of marriage of my sister EMILY HAUGHT to her husband NICHOLAS HAUGHT in this county, I think the REV. SAMUEL ALBRIGHT married them.
SILAS SHREVE buried my husband, but ROWLAND BARR postmaster of LOWMAN, W.Va. furnished the burial clothes, and I reckon the county paid the bill. Questions freely understood and answers correctly received herein as read to me. The burial clothes were bought about 4 PM at ROWLAND BARRS and during the afternoon of the day he, my husband died, which was April 17-06.

Beckett, a special examiner of the Bureau of Pensions, personally appeared LIVA HENDERSHOT, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
I am 71 years of age P.O. Artisan, W.Va. residence near same, wife of ELIJAH HENDERSHOT. The claimant is my daughter. She was never married except to DAVID B. FLUHARTY, the soldier. DAVID was once previously married but his first wife was dead ???? ???? married lives, at least that was what I have always understood. MARY is no doubt his lawful widow. MARY has not remarried and she has no property or income. I was present at the births of LEE, WALTER, DESSIE, and JASPER. No sir I cannot recall the day month or year of any one of their births and I did not try to remember the dates not expecting to be called upon to give them later. Nor do I recall either day month or year of birth of either JASON LEE, ELIJAH, NICHOLAS, or JAMES HOWARD. I know that there was about two years elapsed between the births of the children. That is as nearly as I can tell. No, I can't tell whether there is even about two years between NICHOLAS and JAMES HOWARD or not- I recollect MARY married FLUHARTY in the month of SEPTEMBER but I forget the year. Well they had not been married quite a year when JASON LEE, the oldest child was born. JASON LEE was about two years old when MINNIE M. was born.
When WALTER was born MINNIE was about 2 years old, maybe a little over, maybe a little under-but about two years between WALTER and DESSIE and so on down the line as nearly as I can tell.
I have been sick about a year and my memory has failed.
When I testified I told MR. JOHNSTON the names at whose births I was present and I reckon he put the dates down to suit himself.
Well, yes EMILY and NICHOLAS HAUGHT were married about the time of one of the births of the FLUHARTY children. That was WALTER-yes I recollect WALTER was born not long after their marriage. "MINNIE", line 11, our niece" born" line 12, erased before signing.

I have as record our marriage license recorded at New Martinsville. REV. SAMUEL ALBRIGHT married us. No sir the claimant who is my sister was never married except to DAVID B. FLUHARTY, the said had previously married but once though. His first wife was dead several years it was claimed when MARY, the claimant married him. I was present at the birth of four of them, namely DESSIE, JASPER N., NICHOLAS M., and JAMES HOWARD FLUHARTY.

Well, DESSIE was born indeed I can't tell the day, month or year of her birth. Nor can I tell the day, month, or year of JASPER'S birth. Nor can I tell exact date of NICHOLAS birth but likewise born in the month of May, and in the year 1900-forget what part of the month. As I recollect JAMES HOWARD was born in the year 1904 and sometime during the first part of the year, January I think.
No, I could not say if it was March 7 instead of sometime in January.
No, sir, I have no idea as to the day, month, or year of birth of WALTER or ELIJAH, nor of MINNIE, but I recall that JASON LEE was born I think about 20 years ago this summer, the summer immediately following the marriage of his parents, and they had been married close to a year when JASON LEE was born. Question. Wasn't one of the children born just before or just after you and your husband were married? Answer. Yes, one was born the winter immediately following our marriage in August, but I forgot the month of the childs birth- Well, that child was WALTER F.-Yes, I am positive that WALTER was born during the winter immediately following our marriage.
No, I have never had a child. If so, I might recall her children's ages better.
Well, JASON LEE is about 2 years older than MINNIE M. whether a little over or a little under, I forget.
Well there is about two years between MINNIE and WALTER, whether under or over two years I forget.
Oh there is just about two years difference in their ages of WALTER and DESSIE, but whether over or under 2 years I forget. And about two years between JASPER and ELIJAH, and I think something over 2 years, but I think less than 3 years as I recollect until JASPER N. was born, they came along about every two years, after that farther apart. And I think close to three years between JASPER and NICHOLAS but I think under three years and I think more time elapsed between dates of births of NICHOLAS and JAMES than between any other two, and I think close to four(4) years elapsed between their births- whether a little over or a little under 4 years, I forget- whether NICHOLAS wore pants when JAMES was born I forget but I recall that he was about old enough to change to pants.
When I made my affidavit, my sister, the claimant, and I talked over the matter and she could recall the months and days and we fixed the years by counting back---This is the best I can do in this case.

Beckett, a special examiner of the Bureau of Pensions, personally appeared SARAH M.COZART, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
I am 71 years of age wife of JAMES M. COZART P.O. Artisan, W.Va. residence near same. I am fully satisfied that claimant is the lawful widow of the soldier DAVID B. FLUHARTY. I did not know soldier until after he married claimant, but I knew claimant at or about Proctor from her childhood. Claimant ha not remarried, she has no property or income but from daily labor. I was present at the birth of three of claimants children namely; JASPER NEWTON, NICHOLAS MACK, and JAMES HOWARD. In fact I saw DESSIE right off hand and dressed her for the first time. No, I did not give the exact date, month nor year of those three children. In fact I can give the day, month or year of birth of any one of those children, nor the day, month nor year of the birth of JASON LEE, MINNIE, WALTER, or ELIJAH. Know nothing about their births. In fact DESSIE was the first one born after we moved to this neighborhood and I am told that ELIJAH was born on SHENANGO later on.
Well, sir, claimant furnished the information in my affidavit. I did not know that present securing as to the dates of births and simply that I was present and know those children to have been born.-JASPER N., NICHOLAS M., and JAMES HOWARD FLUHARTY. No idea how much time occurred between the dates of birth of any of the children. No, don't recall how much time between dates of birth of NICHOLAS and JAMES-I kept no record of those children's births and have no family record in other circumstance in date that would aid me in recall the dates of their births.
DAVID B. FLUHARTY, the soldier died last April, a year ago but I forget the day of the month.
Well, he died of a fever of some kind and lived only about a week or 8 or 9 days after taken down-Well he had been ailing more or less all winter-No, he had no chronic disease that I know of.
Not related to claimant nor was I to soldier- I am not interested in the case at all.

P.O. Artisan, W.Va. Farmhand, I reside with my mother the claimant. Well, sir, it has been my understanding ever since I was old enough to know about my age that I was born near where mother lives on the 20th day of January. No, I don't know in what year I was born-Well, I am led to believe that I was 16 years of age on the 20th day of last January. Well I have known my age ever since I was about eleven years old--No, sir, there has not been a time when I was told by either parent or anyone else that I was mistaken as to number of years old I thought I was, that is, a year or two older, or on the other hand a year or two younger than I thought I really was-Yes sir, each year added another year. No, sir, no change at all except add a year at each birthday anniversary-Yes, sir, I feel satisfied that I was just 16 years old on January 20th last-I don't remember when NICHOLAS was born, but I think he will be 8 years old his next birthday, but I forget the day, month or year of his birth. As for JAMES HOWARD he was born March 7th 1904. I remember the day of his birth. Don't believe I can tell age of JASON LEE, but MINNIE is, I have always understood, 2 years older than myself. How much over 2 years I do not know, but not much more. I do not recall the alleged day, month, or year of her birth. Well, I am older than DESSIE, only two years and 3 days older than DESSIE.
That has always been my understanding from the time I was old enough to know about my own age and from the time I was about 11 years old-She was born January 23rd, but I can't tell what year. I don't believe I can tell how much older DESSIE is than JASPER N., but he was born the 11th day of March, don't know what year. Well, I don't know how much younger he is than myself, but perhaps I could tell by counting up-I don't know the day, month, or year of ELIJAH'S birth-Father died in April 1906, and on the 15th or 16th. I don't know which. Yes, sir, since you mentioned it he died on the 17th April, and in the year 1906. I saw him die. No, I don't know how much younger MINNIE is than JASON LEE. Not interested except as a son-Mother has no property or income of her own.

I do not know the dates of births of any of the FLUHARTY children-the claimants children except I know the month and year of birth of JAMES HOWARD FLUHARTY, the youngest child, and he was born in March, 1904, but I forget the day-I wasn't present otherwise I might know-as I try to remember such matters. JAMES HOWARD FLUHARTY was born during March 1904 and during the year our son RUSSELL HENDERSHOT was born and RUSSELL was born July 16, 1904. JAMES HOWARD and RUSSELL are each three years old on their last birthday anniversaries. We have no FAMILY BIBLE but my husband has our two boys and one a boy and the other a younger girl-down in a pass book which he has at work (at HASTINGS). Not interested in case other than a niece.

A native of West Virginia, was born in Marion County, 02 Sept 1845, and came to Wetzel County in the fall of 1855. He is the son of James Fluharty deceased, and Lucinda J. Jones, who is still living. He was married first in this country, 19 Jan 1865 to Euseba Anne Matheny,. He was married secondly to Mary Hendershot. When the war broke out his heart was with the Northern Cause and was enrolled 25 Mar 1861, at Wheeling, WV, as a private in Co.H 1st WVA V.I. He took active part in the Battles of New Market, Berryville, Cedar Creek, and Piedmont; at the latter conflict he was wounded 05 June 1864, in leg and below the knee; he was taken to hospital at Grafton, WVA, where he received medical treatment for two months. In August, 1864, he was furloughed for 30 days and returned to duty at the end of that time. 'he was consolidated with Co F, and VVI and was honorably discharged 02 June 1865, at Washington, DC. His brothers John and Joseph served in the late war. Comrade Fluharty is by occupation a farmer and his address is Pine Grove.

On this 8th day of May, A.D. one thousand nine hundred and six personally appeared before me, a Notary Public within and for the county and state aforesaid, MARY FLUHARTY, aged 44 years, a resident of Mobley, County of Wetzel, State of W.Va., who, being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the act of Congress approved June 27, 1890, as amended by the act of May 9, 1900.
That she is the widow of DAVID B. FLUHARTY, who was under the name of DAVID B. FLUHARTY on the 24th of March, 1864 as a private in Co. H 1st Regiment W.Va. Vol. INF. and honorably discharged June 2nd 1865, having served ninety days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above.
That she was married under the name of MARY HENDERSHOT to said soldier at W.J. RINE'S residence on the 30th day of September, 1886, by W.J.Rine; that there was no legal barrier to that marriage; that she had not been previously married; that the soldier had been previously married.
Former wife of soldier died about 5 years prior to last marriage.
That the said soldier died April 17, 1906, at his home that she was not divorced from him; that she had not remarried since his death; and that she is without other means of support than her daily labor and an actual net income not exceeding two hundred and fifty dollars per year.
That the said soldier left the following named children who are now living and under sixteen years of age, to wit:

Beckett, a special examiner of the Bureau of Pensions, personally appeared MARY FLUHARTY, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
I am 44 years of age; my post office address is Artisan, Wetzel County, West Virginia, residence near same.
Claimant was born Sept. 23, 1862. I had my mail sent to Mobley because Mr. JOHNSTON who has been doing my writing lives there and he would know when to come to see me about getting testimony.
In an application for pension under law June 27, 1890, as the widow of DAVID B. FLUHARTY who served in Co. H 1st W.Va. Vol. Inf., and who died in this house on April 17, 1906. "I have his death sat down", (In an Agricultural report of 1898 is recorded=DAVID B. FLUHARTY died on the 17th of April 1906".GMB) This death was sat down by his niece a few days after he died---
My maiden name was MARY HENDERSHOT, and I moved here to this neighborhood from the time I was about 18 years, having moved here from near Proctor, this county where I had always lived. I married the soldier DAVID B. FLUHARTY in this county as I recollect the last thing in September and in the year 1886. REV. JACKSON RICE married us. I had not been previously married. My husband had been previously married and once only. His first was MISS METHENY but was married possibly under the name of GRAY-at any rate she, LASEBY ANN was dead about 5 years when I married the soldier, DAVID B. FLUHARTY, and LASEBY ANN died right near Pine Grove. Soldier and I lived together continuously from the date of our marriage to each other in Oct. 1886 until his death in April 17, 1906.
Well my husband had been dead about a month when I made my application for pension. No divorce or separation between us. I have not remarried and don't expect to either. My husband left no life insurance in will or property for that matter. I have no property whatsoever and no income except what my children
and myself earn. My husband died after a long illness, but I don't know what caused his death-Dr. McCLELLAND, Jacksonburg said he had lung fever and pneumonia. He called the last time the day before my husband died. I had eight children by the soldier DAVID B. FLUHARTY, and all are living and the two eldest, Jason Lee and Minnie May are married, the other six are living at home with me.
Neither of us could write to do any good so a record was neglected. All were born here at or near Artisan except ELIJAH BENTON and MINNIE MAY were born near Pine Grove. I can recollect the month and day of birth of each of my 8 children, but the years bother me except in the case of JASON LEE who was born in 1887-"That was the first."

Yes, I am positive that the month and days are correct JASON LEE was born July 16, 1887, the next July after our marriage and he was one year and about nine months old when MINNIE MAY was born, and MINNIE MAY was about one year and nine months old when WALTER FRANCIS was born. That is as nearly as I can recollect. Well, sir, WALTER FRANCIS was two years and three days old when DESSIE, a girl, not Dennis, a boy - was born- two years from January 20th to January 23rd. No, I can't tell you the year of WALTER F. 's birth or the year of DESSIE'S birth- But my idea is that Jan'y 20th last was his 16th birthday, and that DESSIE was only 14 years old Jan'y 23rd last. Well DESSIE was born two years and from Jan'y 23rd to this 18th of March before JASPER N. was born but I can't recall the year- No, not over 3 years, that is not correct. Not three years between any of these births except the last two there was about 4 years between theirs. I reckon from March 7th to May 15th less than four years. Well JASPER NEWTON was two years old and from March 18th to Oct. 17th older than ELIJAH B. , but I forgot the year. Well Elijah B. was two years old from Oct. 17th till May 17th old when NICHOLAS M. was four years less from Mar. 7 to May 15th old when JAMES HOWARD was born. Well I can't say as to the respect ??? believes my husbands statement to this office over mine.

Or character- I am advised that in the former WALTER F. is shown to have been born in 1891 and DESSIE in 1893, whereas my recollection shows them born in 1890 and 1892 respectively, but I can't correct the ????? anymore than to say, that the periods between their births are actually given today. I tried to tell Mr. Johnston as best I could but he evidently got the years of WALTER'S and DESSIE'S wrong. I had no Doctor's at any of them except in the case of ELIJAH.
My brother JASON HENDERSHOT and I tried to figure out their years not long ago last summer-I believe and he put down what he thought their correct ages from what I told him, he not recalling any of their ages himself-(List shown and agrees with family calculation and shows NICHOLAS born May 15, 1900 and JAMES H. March 7, 1904-GMB) When WALTER was born my mother LIVA HENDERSHOT was here. Others present are now dead. When DESSIE was born LIVA HENDERSHOT, EMILY HAUGHT were present. When JASPER N. was born, LIVA HENDERSHOT, EMILY HAUGHT and SARAH A. COOPER were present. When ELIJAH B. was born, he was born on SHENANGO RUN, DR. STONE was present as soon as he could get there, and Mrs. MARIA(AMARZIAH) BROWN and GRANDMA FLUHARTY now dead. When NICHOLAS M. was born EMILY HAUGHT, S.A. COZART were present. There is no particular event that I recall by which I can fix the date of birth of anyone of my children except in the case of WALTER F., and he was born on Jan'y 20th immediately following the date of marriage of my sister EMILY HAUGHT to her husband NICHOLAS HAUGHT in this county, I think the REV. SAMUEL ALBRIGHT married them.
SILAS SHREVE buried my husband, but ROWLAND BARR postmaster of LOWMAN, W.Va. furnished the burial clothes, and I reckon the county paid the bill. The burial clothes were bought about 4 PM at ROWLAND BARRS and during the afternoon of the day he, my husband died, which was April 17-06.

I am 71 years of age P.O. Artisan, W.Va. residence near same, wife of ELIJAH HENDERSHOT. The claimant is my daughter. She was never married except to DAVID B. FLUHARTY, the soldier. DAVID was once previously married but his first wife was dead ???? ???? married lives, at least that was what I have always understood. MARY is no doubt his lawful widow. MARY has not remarried and she has no property or income. I was present at the births of LEE, WALTER, DESSIE, and JASPER. No sir I cannot recall the day month or year of any one of their births and I did not try to remember the dates not expecting to be called upon to give them later. Nor do I recall either day month or year of birth of either JASON LEE, ELIJAH, NICHOLAS, or JAMES HOWARD. I know that there was about two years elapsed between the births of the children. That is as nearly as I can tell. No, I can't tell whether there is even about two years between NICHOLAS and JAMES HOWARD or not- I recollect MARY married FLUHARTY in the month of SEPTEMBER but I forget the year. Well they had not been married quite a year when JASON LEE, the oldest child was born. JASON LEE was about two years old when MINNIE M. was born.
When WALTER was born MINNIE was about 2 years old, maybe a little over, maybe a little under-but about two years between WALTER and DESSIE and so on down the line as nearly as I can tell.
I have been sick about a year and my memory has failed.
When I testified I told MR. JOHNSTON the names at whose births I was present and I reckon he put the dates down to suit himself.
Well, yes EMILY and NICHOLAS HAUGHT were married about the time of one of the births of the FLUHARTY children. That was WALTER-yes I recollect WALTER was born not long after their marriage. "MINNIE", line 11, our niece" born" line 12, erased before signing.

FLUHARTY, the said had previously married but once though. His first wife was dead several years it was claimed when MARY, the claimant married him. Claimant has not remarried-but she has no property or income. Soldier died April 17, 1906. She had 8 children by the soldier and all are living. I was present at the birth of four of them, namely DESSIE, JASPER N., NICHOLAS M., and JAMES HOWARD FLUHARTY.
I have no record of the births of any of them. I testify purely from memory.
Well, DESSIE was born indeed I can't tell the day, month or year of her birth. Nor can I tell the day, month, or year of JASPER'S birth. Nor can I tell exact date of NICHOLAS birth but likewise born in the month of May, and in the year 1900-forget what part of the month. As I recollect JAMES HOWARD was born in the year 1904 and sometime during the first part of the year, January I think.
No, I could not say if it was March 7 instead of sometime in January.
No, sir, I have no idea as to the day, month, or year of birth of WALTER or ELIJAH, nor of MINNIE, but I recall that JASON LEE was born I think about 20 years ago this summer, the summer immediately following the marriage of his parents, and they had been married close to a year when JASON LEE was born. Question. Wasn't one of the children born just before or just after you and your husband were married? Answer. Yes, one was born the winter immediately following our marriage in August, but I forgot the month of the childs birth- Well, that child was WALTER F.-Yes, I am positive that WALTER was born during the winter immediately following our marriage.
No, I have never had a child. If so, I might recall her children's ages better.
Well, JASON LEE is about 2 years older than MINNIE M. whether a little over or a little under, I forget.
Well there is about two years between MINNIE and WALTER, whether under or over two years I forget.
Oh there is just about two years difference in their ages of WALTER and DESSIE, but whether over or under 2 years I forget. And about two years between JASPER and ELIJAH, and I think something over 2 years, but I think less than 3 years as I recollect until JASPER N. was born, they came along about every two years, after that farther apart. And I think close to three years between JASPER and NICHOLAS but I think under three years and I think more time elapsed between dates of births of NICHOLAS and JAMES than between any other two, and I think close to four(4) years elapsed between their births- whether a little over or a little under 4 years, I forget- whether NICHOLAS wore pants when JAMES was born I forget but I recall that he was about old enough to change to pants.
When I made my affidavit, my sister, the claimant, and I talked over the matter and she could recall the months and days and we fixed the years by counting back---This is the best I can do in this case.

I am 71 years of age wife of JAMES M. COZART P.O. Artisan, W.Va. residence near same. I am fully satisfied that claimant is the lawful widow of the soldier DAVID B. FLUHARTY. I did not know soldier until after he married claimant, but I knew claimant at or about Proctor from her childhood. Claimant ha not remarried, she has no property or income but from daily labor. I was present at the birth of three of claimants children namely; JASPER NEWTON, NICHOLAS MACK, and JAMES HOWARD. In fact I saw DESSIE right off hand and dressed her for the first time. No, I did not give the exact date, month nor year of those three children. In fact I can give the day, month or year of birth of any one of those children, nor the day, month nor year of the birth of JASON LEE, MINNIE, WALTER, or ELIJAH. Know nothing about their births. In fact DESSIE was the first one born after we moved to this neighborhood and I am told that ELIJAH was born on SHENANGO later on.
Well, sir, claimant furnished the information in my affidavit. I did not know that present securing as to the dates of births and simply that I was present and know those children to have been born.-JASPER N., NICHOLAS M., and JAMES HOWARD FLUHARTY. No idea how much time occurred between the dates of birth of any of the children. No, don't recall how much time between dates of birth of NICHOLAS and JAMES-I kept no record of those children's births and have no family record in other circumstance in date that would aid me in recall the dates of their births.
DAVID B. FLUHARTY, the soldier died last April, a year ago but I forget the day of the month.
Well, he died of a fever of some kind and lived only about a week or 8 or 9 days after taken down-Well he had been ailing more or less all winter-No, he had no chronic disease that I know of.
Not related to claimant nor was I to soldier- I am not interested in the case at all.

Well, sir, it has been my understanding ever since I was old enough to know about my age that I was born near where mother lives on the 20th day of January. No, I don't know in what year I was born-Well, I am led to believe that I was 16 years of age on the 20th day of last January. Well I have known my age ever since I was about eleven years old--No, sir, there has not been a time when I was told by either parent or anyone else that I was mistaken as to number of years old I thought I was, that is, a year or two older, or on the other hand a year or two younger than I thought I really was-Yes sir, each year added another year. No, sir, no change at all except add a year at each birthday anniversary-Yes, sir, I feel satisfied that I was just 16 years old on January 20th last-I don't remember when NICHOLAS was born, but I think he will be 8 years old his next birthday, but I forget the day, month or year of his birth. As for JAMES HOWARD he was born March 7th 1904. I remember the day of his birth. Don't believe I can tell age of JASON LEE, but MINNIE is, I have always understood, 2 years older than myself. How much over 2 years I do not know, but not much more. I do not recall the alleged day, month, or year of her birth. Well, I am older than DESSIE, only two years and 3 days older than DESSIE.
That has always been my understanding from the time I was old enough to know about my own age and from the time I was about 11 years old-She was born January 23rd, but I can't tell what year. I don't believe I can tell how much older DESSIE is than JASPER N., but he was born the 11th day of March, don't know what year. Well, I don't know how much younger he is than myself, but perhaps I could tell by counting up-I don't know the day, month, or year of ELIJAH'S birth-Father died in April 1906, and on the 15th or 16th. I don't know which. Yes, sir, since you mentioned it he died on the 17th April, and in the year 1906. I saw him die. No, I don't know how much younger MINNIE is than JASON LEE. Not interested except as a son-Mother has no property or income of her own.

Case of MARY FLUHARTY w/o No. 848,710
On this 5th day of August 1907 near Artisan, County of Wetzel, State of W.Va., before me George M. Beckett, a special examiner of the Bureau of Pensions, personally appeared DESSIE FLUHARTY, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
P.O. Artisan, W.Va. residence near same. Daughter of the claimant. To the best of my knowledge and belief I was fourteen years in Jan'y 23rd last. No, sir, I don't know in what year I was born. I have known my age for several years and believe I was 14 on Jan'y 23rd last. Well, I have understood for years that I am two years and 3 days younger than WALTER.
Well, I am 2 years and a little over older than JASPER.
Don't know how old ELIJAH is-
Don't recall dates of birth of NICHOLAS or JAMES, but NICHOLAS was 7 years old last May and JAMES was 3 years old sometime last March..
Not interested except as a daughter.

On this 6th day of August 1907 near Artisan, County of Wetzel, State of W.Va., before me George M. Beckett, a special examiner of the Bureau of Pensions, personally appeared NORA E. HENDERSHOT, who, being by me first duly sworn to answer truly all interrogations propounded to her during this special examination of a foresaid claim for pension, deposes and says:
I am 22 years of age. P.O. Artisan, W.Va. wife of J.W. HENDERSHOT who is a son of JASON and ALICE A. HENDERSHOT and a nephew of the claimant.
I do not know the dates of births of any of the FLUHARTY children-the claimants children except I know the month and year of birth of JAMES HOWARD FLUHARTY, the youngest child, and he was born in March, 1904, but I forget the day-I wasn't present otherwise I might know-as I try to remember such matters. JAMES HOWARD FLUHARTY was born during March 1904 and during the year our son RUSSELL HENDERSHOT was born and RUSSELL was born July 16, 1904. JAMES HOWARD and RUSSELL are each three years old on their last birthday anniversaries. We have no FAMILY BIBLE but my husband has our two boys and one a boy and the other a younger girl-down in a pass book which he has at work (at HASTINGS). Not interested in case other than a niece.
